These Terms of Use ("Terms") constitute a legally binding agreement between you ("you", "your") and Futurewise AB, operating under the brand name Unseen Progress ("we", "us", "our"), governing your access to and use of all apps in the Unseen Progress portfolio.
These Terms apply to every app in the portfolio — currently all 18 apps: AnxietyStrong, BrainStrong, MealStrong, CareStrong, DownStrong, FocusStrong, LearnStrong, MuteStrong, ParkinStrong, PawStrong, SeizureStrong, SensoryStrong, SpectrumStrong, SpeechStrong, StepStrong, StrokeStrong, StutterStrong, and TicStrong.
All of these apps are built on the same engine and governed by these same terms. By downloading, installing, or using any Unseen Progress app, you agree to be bound by these Terms. If you do not agree, do not use our apps.

OUR APPS ARE NOT MEDICAL DEVICES AND DO NOT PROVIDE MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT.
Our apps are self-help tools designed to help caregivers track patterns and reflect on progress. They are provided solely for informational, educational, and self-tracking purposes and are not a substitute for professional medical, psychological, therapeutic, legal, or financial advice.
Nothing in our apps should be interpreted as a diagnosis, treatment recommendation, or clinical opinion. You must not rely on our apps when making medical or health-related decisions.
If you or the person you are caring for is experiencing a medical emergency or mental health crisis, contact your local emergency services or a qualified professional immediately. Do not delay seeking professional help because of information tracked or read within our apps.
You expressly acknowledge and agree that:
(a) any reliance on our apps is at your sole risk; (b) you are solely responsible for all decisions, actions, and outcomes arising from your use of our apps; and (c) we make no claims about outcomes — individual results vary.

We grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to use our apps for personal, non-commercial purposes on devices you own or control. This license does not transfer any ownership rights to you.

All content in our apps — including but not limited to text, assessments, course material, illustrations, icons, design, code, and branding — is owned by Futurewise AB (operating as Unseen Progress) or used under license. All rights are reserved.
The app names, logos, and visual identity of each app in the portfolio are trademarks of Unseen Progress. You may not use them without prior written permission.

Any data you enter into our apps (check-in entries, notes, audio recordings, onboarding answers) belongs to you. As described in our Privacy Policy, all user data is stored locally on your device and is never transmitted to us or any third party.
You are solely responsible for maintaining backups of your device and your data.
Uninstalling an app permanently deletes your data — we cannot recover it. To the maximum extent permitted by applicable law, we accept no liability for any loss, corruption, or unavailability of your data, regardless of cause, including but not limited to device failure, software updates, unauthorized access, or deletion.

Some features in our apps require a paid subscription or one-time purchase. All purchases are processed through Apple's App Store or Google Play — we never handle your payment information directly.

Our apps are provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.
We do not warrant that our apps will be uninterrupted, error-free, secure, or free of harmful components. We do not warrant that any content is accurate, complete, or current.

To the maximum extent permitted by applicable law:
(a) Futurewise AB (operating as Unseen Progress) and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, use, goodwill, or other intangible losses, whether incurred directly or indirectly, resulting from:
(b) The total aggregate liability of Futurewise AB for any and all claims arising out of or relating to these Terms or your use of our apps shall not exceed the greater of: (i) the total amount you paid us in the twelve (12) months immediately preceding the event giving rise to the claim; or (ii) fifty (50) Swedish kronor.

You agree to indemnify, defend, and hold harmless Futurewise AB (operating as Unseen Progress) and its officers, directors, employees, and agents from and against any and all claims, damages, liabilities, losses, and expenses (including reasonable legal fees) arising out of or relating to:

We may suspend or terminate your access to our apps at any time, for any reason, without notice. Upon termination, your license to use the apps is immediately revoked.
Since our apps work offline with locally stored data, "termination" in practice means we may remove the app from sale on app stores or push an update that restricts access.

Before initiating any formal legal proceeding arising out of or relating to these Terms, you agree to first attempt to resolve the dispute informally by contacting us at feedback@unseenprogress.com. Both parties agree to use good faith efforts to resolve the dispute within thirty (30) days of the initial contact.

These Terms are governed by the laws of Sweden, without regard to conflict of law principles.
Any dispute arising from or relating to these Terms or your use of our apps shall be subject to the exclusive jurisdiction of the courts of Sweden.

Nothing in these Terms is intended to limit or exclude any rights you may have under mandatory consumer protection legislation applicable in your jurisdiction, including but not limited to the Swedish Consumer Sales Act (konsumentkoplagen) and the Swedish Consumer Services Act (konsumenttjanstlagen). Where such mandatory rights apply, they take precedence over any conflicting provision of these Terms.

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. Material changes will be communicated through the app or our website.
Continued use of our apps after changes are posted constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using our apps.

If any provision of these Terms is held to be invalid or unenforceable, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Futurewise AB regarding your use of our apps, and supersede any prior agreements or understandings.
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
